Transitional justice: outrage, tension and reconciliation in the Colombian political-social conflict

Abstract

The approaches of the transitional justice seek the reestablishment of the natural conditions of the governmental institutions, of the truth, of the justice, and of the reparation. Recently, from this approach of justice, the Colombian legal order incorporated two special and complementary models. From a brief analysis of the two mentioned models, the author suggests that the occurrence of the conflict and the presence of the victims make evident the practical weakness of the political government and the fragility of the democracy. Based on these ideas, Plata supports that the cited transitional justice models partially aid to solve the problem (material spaces of reparation), but themselves should be accompanied by the civil society by the creation of a conflict awareness level (symbolic spaces of reparation) inspired in the moral sense of the indignation, unique enabler of the reconciliation.
